Terms of Use
Last updated: October 29, 2026
1. Using MemoryIndex
These terms govern your use of MemoryIndex.io, including its data, charts, API and paid services. By using the site, you agree to these terms. If you disagree, do not use it. Mandatory consumer rights remain unaffected.
2. Market information, not advice
Content is for information only, not investment, financial, procurement or other professional advice, a binding quote, or an offer to supply components. Reported, derived and estimated levels differ; some charts and refreshes are modeled, not live trades. Sources may be delayed or wrong. Independently verify information before trading or buying. MemoryIndex is not affiliated with or endorsed by cited publishers or manufacturers.
3. Content and acceptable use
MemoryIndex and its licensors retain their intellectual-property rights; third-party material belongs to its owners. Use content only as permitted by your plan or written permission. Do not resell or republish datasets, bypass access controls, share account credentials, scrape in violation of your license, overload the service, or use it unlawfully. Limited quotations must identify the source and comply with applicable law. We may restrict access for misuse; mandatory rights remain protected.
4. Subscriptions and outside links
Prices, billing periods and included features are shown at checkout. Subscriptions renew automatically until canceled through your account; cancellation retains access through the paid period. Mandatory cancellation and refund rights apply. Stripe processes payments. Linked sellers, affiliate offers and third-party sites operate under their own terms; we do not guarantee their stock, prices or performance. Submitting a quote inquiry does not create a supply contract.
5. Disclaimer and liability
To the fullest extent permitted by law, services are provided as is and as available, without warranties of accuracy, completeness, availability, merchantability, fitness or non-infringement. We are not liable for indirect or consequential losses, lost profit, lost data, trading or purchasing losses. For business customers only, where lawful, our total liability relating to the service is limited to the fees you paid us in the preceding 12 months. This cap does not apply to mandatory consumer remedies. These limits do not exclude fraud, willful misconduct or any liability or consumer remedy that cannot lawfully be excluded. Business users agree to indemnify us against third-party claims arising from their unlawful use or infringement, to the extent permitted by law.
6. Changes and disputes
We may update the service and these terms; the revision date appears above. Material changes affecting a paid subscription will be notified before taking effect where required. Changes do not remove accrued or mandatory rights. Contact us first to try to resolve a dispute; you retain any right to use the courts or remedies available under applicable law. If a provision is unenforceable, the rest remains effective.
7. Accounts, authority and API credentials
You must have legal capacity to contract, give accurate account and billing information and have authority to bind any organization you represent. Keep passwords and API keys confidential and promptly report suspected compromise. You are responsible for your authorized users and actions you authorize, but not automatically liable for unauthorized activity beyond your control. A subscription licenses the listed features; it does not transfer ownership of data or guarantee a commercial outcome. API use is subject to the purchased plan's quotas, permitted uses and documentation. A visual blur on a public page is a presentation restriction, not a promise that the underlying data is confidential or technically inaccessible.
8. Billing, cancellation and refunds
Starter and Pro have monthly or annual paid billing; there is no free trial. The checkout total, currency, taxes where displayed, renewal interval and plan features govern your purchase. Your bank may charge currency-conversion or other fees outside our control. You authorize the recurring payment disclosed at checkout; legally required renewal notices and consent rules still apply. Cancel future renewal through Account; if you cannot access the cancellation control, email us for assistance. Deleting an account or stopping use is not a substitute for canceling renewal. Plan changes follow the account and checkout terms shown when requested. We do not promise discretionary refunds for unused time; statutory withdrawal, defective-service, duplicate-charge and other mandatory remedies remain available. Price changes do not apply retroactively and require notice or renewed consent where law requires it.
9. Regional consumer safeguards
Mandatory local consumer laws prevail over conflicting terms. EEA and UK consumers may have a 14-day withdrawal right for eligible distance contracts. Starting digital content or services does not itself erase that right: any lawful loss or adjustment requires the applicable express consent, acknowledgment and performance conditions. Swiss consumers retain applicable mandatory rights; we do not assume a universal online cooling-off right. US state automatic-renewal and consumer laws, Canadian provincial laws including Quebec, and applicable Asian consumer laws govern notices, consent, cancellation and remedies where relevant. No clause imposes compulsory arbitration, waives a non-waivable class-action right or forces a consumer to litigate outside a legally protected home forum. Regional privacy rights are described in the Privacy Policy.
10. Fraud, security and unlawful activity
Do not impersonate others, submit false component requests, use stolen payment credentials, make deliberately false payment disputes, distribute malware, probe or exploit the site without authorization, conceal prohibited resale, or assist fraud. Good-faith complaints, legitimate chargebacks and lawful security reports are not prohibited. We may investigate credible abuse, request proportionate verification, restrict compromised access, preserve relevant evidence and cooperate with lawful authorities or payment providers. Restrictions and recovery of actual losses remain subject to evidence, applicable law and your right to challenge an error; we do not impose an automatic penalty merely for disputing a payment. Do not use the service contrary to applicable sanctions, export controls or other laws. Report suspected fraud or security issues privately; do not send passwords, full card numbers or exposed API keys by email.
11. Business indemnification and claims
To the extent lawful, a business user must defend and indemnify MemoryIndex, its operator and personnel for third-party claims, reasonable legal costs and damages caused by that user's unlawful use, infringement, materially false submissions or material breach of these terms. This does not cover losses caused by our own negligence or misconduct, or impose a consumer indemnity where unfair or prohibited. We will give reasonably prompt notice and reasonable cooperation; delay reduces the duty only to the extent it prejudices the defense. The responsible business may manage the defense with competent counsel, but cannot admit our fault or impose non-monetary obligations on us without our written consent. No claimant loses a mandatory remedy through this clause. Copyright or data-rights complaints should identify the material, location, claimed right and contact details so we can assess them.
12. Liability limits, service interruption and general terms
The liability limits above apply only where enforceable. They never exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, intentional misconduct, gross negligence where non-excludable, statutory privacy compensation or other non-waivable duties. Mandatory service-quality and consumer guarantees prevail. There is no uptime or forecast guarantee unless separately agreed in writing. Events outside reasonable control may disrupt data sources, hosting or payments; this does not waive mandatory refund or remedy rights. If a paid service is permanently discontinued, we will address prepaid unused service as required by law. Terms on intellectual property, accrued payment obligations, lawful indemnities and liability survive termination only as appropriate. A failure to enforce a clause is not a waiver. These terms and the accepted checkout or written license govern the service; mandatory law controls conflicts. Translations aid understanding and do not diminish local rights. Contact us to resolve claims; no shortened claim deadline or exclusive governing jurisdiction is imposed here.
13. Subscription Terms of Service — Starter and Pro
These subscription Terms of Service supplement the general Terms of Use for MemoryIndex's hosted price terminal, paid research features, exports and API access included in your Starter or Pro plan. The plan and billing option accepted at checkout specify your subscription scope. Specific terms in a separately signed agreement govern conflicts for that agreement; mandatory law always prevails. Access depends on a confirmed paid subscription and may require payment-status synchronization. A payment receipt does not expand the purchased license. Contact us if paid access fails to activate. No reseller, multi-user, redistribution or white-label rights are granted unless expressly included in your plan or a written license.
14. SaaS license, integrations and customer responsibilities
During your paid term, we grant a limited, non-exclusive, non-transferable right to use the subscribed service for your own lawful personal or internal business purposes, subject to your plan. Do not sublicense access, pool credentials across unrelated users, reproduce the service as a competing database, use unauthorized automation to evade quotas, or redistribute bulk data without permission. Statutory exceptions and expressly licensed API uses remain available. You are responsible for compatible devices, internet access, your integrations, secure handling of exported data and compliance with third-party licenses. We do not operate your trading, procurement or investment systems, and you must review outputs before using them. Your confidential submissions remain yours; you authorize only the processing reasonably needed to provide the requested service, as described in the Privacy Policy. This authorization does not grant us ownership of your submissions or permission to publish them.
15. Maintenance, changes, beta features and support
The service may undergo maintenance, bug fixes, source corrections, security updates and changes to formats or integrations. Beta areas, including Semis (Beta), may be incomplete or change; their label does not override mandatory guarantees. Historical reconstructions and the fixed 12-hour modeled refresh are not a promise of exchange-grade live pricing. No service-level agreement, dedicated support response time, custom analysis or perpetual availability is included unless expressly agreed. We will not rely on a general change clause to remove paid essential features without addressing applicable notice, cancellation or refund rights. If a material paid feature is withdrawn, contact us for the remedies required by your agreement or law. Support is available through our contact details; do not submit passwords, full card details or secret API keys.
16. Nonpayment, suspension and the end of service
Failed payments or loss of eligible paid status may interrupt paid features while the billing issue is resolved; a pending bank dispute alone is not proof of fraud. We may proportionately suspend affected access for credible security threats, unlawful activity or material license breaches. Where reasonably feasible and lawful, we will explain the reason and provide an opportunity to resolve the issue; urgent protective action may occur first. Suspension does not automatically cancel recurring billing or justify retaining fees for services we cannot lawfully charge for. Ordinary cancellation stops future renewal and preserves access through the paid period, subject to lawful suspension or termination. On expiration or valid termination, permission to access paid services and make further API calls ends; previously exported material remains subject to its license. Do not rely on the site as your only archive. Account deletion, retained legal records and privacy requests are governed by the Privacy Policy. Any fees due, lawful business indemnities and surviving license restrictions remain subject to mandatory consumer and privacy rights.
